Awaab's Law Explained

Awaab's Law is named after Awaab Ishak, a two year old boy who died in December 2020 following prolonged exposure to mould in his family's social housing flat in Rochdale.

Created under the Social Housing (Regulation) Act 2023, it came into force for social housing landlords across England on 27 October 2025, setting fixed legal timeframes for investigating and fixing damp, mould and other serious hazards once a tenant reports them.

A second phase, extending the same timeframes to further hazards such as excess cold and heat, is due to come into force on 30 November 2026.

Does Awaab's Law Apply To Private Landlords Yet?

Not yet. Awaab's Law currently applies to social housing only. The Renters' Rights Act 2025 contains the power to extend equivalent legal timeframes to private landlords and letting agents, and the government has confirmed this is the intended direction, but no implementation date has been set, and further consultation is expected before it takes effect.

That said, the direction of travel is clear, and landlords who wait until it's mandatory before treating damp and mould seriously are likely to find themselves playing catch up.

Your Current Legal Obligations As A Landlord

Private landlords already have a legal duty under the Homes (Fitness for Human Habitation) Act 2018 to keep rented properties free from serious hazards, including damp and mould, and this duty applies right now, regardless of when Awaab's Law is extended to the private sector.

If a property isn't fit for habitation and the landlord fails to act, tenants can take the matter to court.

Condensation is the single most common cause of the damp and mould reports landlords receive, and it's exactly the kind of hazard Awaab's Law and the Fitness for Human Habitation Act are concerned with.
